Residency in Iran

Main legal instrument about entrance, residency in Iran is “Entrance and residency of foreign nationals Act” ratified in 1931.

According to this Act and its amendments, entering in Iran is generally allowed and for this end, first step is to obtain an entrance permission or visa.

Iran embassy in domicile country of foreign national is in charge of permissions. Unless for following cases, any applicant will obtain a visa;

  1. If applicant use false documents to obtain an entrance permission (visa)
  2. If applicant is an Iran national (see Iran nationality)
  3. If his/her presence in Iran is threat to National security or public interests
  4. If applicant has a criminal record in Iran or elsewhere
  5. If applicant has been expelled from Iran
  6. If applicant failed to assert his/her living arrangement in Iran either through asset or useful job

According to this Act, both addressing and rejecting of applications are administrative decision so they will not be revisable through courts.

  • Types of residency

    • Temporary residency

    • Permanent residency:

      • After 5 years of residency
      • After 2 years of continuous or intermittent residency plus an approval addressing applicants’ high scientific title or his/her proficiency in manufacture or development.
      • After 2 years of continuous or intermittent residency plus an approval addressing applicants’ public interest service.
      • After 2 years of continuous or intermittent residency plus an approval addressing applicants’ investment in manufacture of development.
      • After 2 years of continuous or intermittent residency plus an approval addressing applicants’ wage or salary.
      • And finally, If applicant has an Iranian wife and kid.

Like visa, both addressing and rejecting of applications are administrative decision but a rejected application could be revise through Ministry of Interior Affairs.
